% 09.08.2017 Learned counsel for the petitioner submits that cheque amount was paid to the respondent (complainant) even before filing of the complaint. Learned counsel for the respondent submits that he has received instructions from the respondent that payment has already been received. Therefore, complaint may be quashed.

In view of the above facts, Complaint Case no. 1621/2016 titled M/s. Cholamandalam Investment & Finance Co. Ltd. vs. Smt. Rupender Kaur under Section 138 of the Negotiable Instruments Act, 1881 pending in the Court of learned Metropolitan Magistrate (NI Act) (Central) - 01, Tis Hazari

Courts, Delhi is quashed.

Petition is disposed of in the above terms. Miscellaneous application is disposed of as infructuous.
