O R D E R

An Application under Section 438 Cr.P.C (482 BNSS) read with Section 482 Cr.P.C. (528 BNSS) has been filed on behalf of the Petitioner Salman seeking Anticipatory Bail in case FIR No.186/2024 under Section 323/308/34 IPC registered at Police Station Paharganj, Delhi. 2.

It is submitted that five Anticipatory Bail Applications have been filed by the Applicant which have been dismissed, the last being on 10.07.2024. The Bail is sought on the ground that the Applicant is entitled to Bail on the ground of parity. The I.O had not intentionally filed any Reply before the learned ASJ.

It is submitted in the Status Report that the Complainant Nazaf, son of Abdul Karimuddin had stated that on 14.03.2024 at about 03:30 P.M while he was working in his shop at Chuna Mandi, Paharganj, the Applicant Salman along with his associates namely Jamshed, Alam and Raunak Ali came to his shop and assaulted him with iron rods claiming that he has failed to return the money which had been taken by him. During the incident, Afzal brother of Complainant reached the spot and tried to intervene. However, he was also assaulted and thereafter, the Applicant along with his associates flee from the spot.

During the investigations it has been found that Complainant, the Applicant other co-accused were well known to each other and there existed a monetary dispute between them. The Notice under Section 41A Cr.P.C was served upon co-accused Raunak Ali, who had joined investigations. During the investigations, the Doctor has opined the injury suffered by the Complainant and his brother as grievous in nature. 7.

The Anticipatory Bail has been granted to Mohd. Alam and Jamshed the two co-accused on 28.05.2024. Five Anticipatory Bail Applications have already been dismissed of the Applicant. Multiple raids were conducted and efforts were made to trace the Applicant, but he continues to evade his arrest till date.

Pertinently, for the reasons best known to the Investigating Officer, though the incident is of 14.03.2024, no steps till date have been taken by the I.O for either apprehending the accused or of serving a Notice upon him to join the investigations. It is quite evident that the Investigating Officer has no interest of interrogating the Applicant. Pertinently, the other two coaccused Mohd. Alam and Jamshed who had a similar role, have already been granted Anticipatory Bail.

Considering the totality of circumstances, it is hereby directed that in the event of his arrest, the Petitioner shall be admitted to bail by the Investigating Officer/Arresting Officer subject to the following conditions: (i) The petitioner shall furnish a personal bond in the sum of Rs.25,000/- with one surety in the like amount from a family member to the satisfaction of the Investigating Officer/Arresting Officer;

(ii) The petitioner shall furnish to the Investigating Officer a cellphone number on which the Petitioner may be contacted at any time and shall ensure that the number is kept active and switchedon at all times; (iii) If the petitioner has a passport, he shall surrender the same to the Investigating Officer and shall not travel out of the The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.
