The grievance in the writ petition is to the fact that as per the petitioner he booked a ticket to ply from Delhi to Bhubaneswar and return. Onward journey form Delhi to Bhubaneswar was by the flight IT 4608 and the return IT 4677.

Petitioner claims that he booked a ticket from the online portal of R-4, Kingfisher Airlines Ltd. but at the airport he was told that the flight would be that of Deccan Aviation Ltd. Petitioner alleges harassment. 3.

Status report has been filed as per which on inquiry it surfaced that the e-ticket in question was booked on March 08, 2008 for a journey to be undertaken on March 12, 2008. Payment was through a credit card. In the e-ticket generated it was indicated that the ticket was booked in 'T21PDN' W.P.(CRL) 370/2008

fare basis category. It was mentioned that the ticket would earn applicable King Miles, except the tickets booked in 'R', 'Z', 'X' & 'T' category. As per the status report, at the relevant time ownership of respondent No.5 was with respondent No.4.

The web portal of respondent No.4 was issuing tickets for Deccan flights as well. The web portal clearly indicated that the flight number was IT4*** and it was explained that wherever it was indicated by showing asterisks, the same would be for Deccan Airways Flight.

Under the circumstances, the status report shows that no cognizable office is made out, a finding with which I concur. 5.

If the petitioner still has an issue to be raised he is free to file a private complaint in the Court of the learned Metropolitan Magistrate. 6.

The petition is dismissed.

No costs.
