The learned counsel for the applicant seeks liberty to withdraw the present bail application and file it afresh before the learned Trial Court.

He submits that the present application was filed seeking bail on medical grounds. He submits that he has received instructions to file a bail application on merits before the learned Trial Court.

The learned counsel for the respondent submits that the applicant had also sought bail on medical grounds before the Hon'ble Apex Court, but the same was rejected. He submits that no order could have been passed in the present petition even otherwise.

withdraw, the present bail application is dismissed as withdrawn. The applicant is at liberty to file the bail application afresh on merits, if permissible.

It is made clear that this Court has not given any opinion on the maintainability of any such application that may be filed by the applicant before the learned Trial Court and the same be considered on its own merits and be decided in accordance with the law.
