This is a revision petition under Section 115 of CPC wherein the petitioner has assailed the impugned order dated 10.10.2022 passed by the learned Trial Court, whereby the respondent/defendant was allowed to file written statement despite delay of 595 days, subject to payment of costs.

It is evident that although there was a contumacious delay, at the same time, the respondent/defendant was well protected in law in view of the directions passed in Re: Cognizance for Extension of Limitation, Suo Motu Writ Petition (Civil) No.3 of 2020 by the Supreme Court, whereby the period of limitation had been extended from 15.03.2020 till 28.02.2022.
