Regular First Appeal under Section 96 of the Code of Civil Procedure, 1908, has been filed on behalf of the Appellants, to challenge the final decree of partition passed by Judgment and Decree dated 20.11.2024 essentially, the contention was that the Appellants are the wife and daughter of Mr. Rajesh Kumar Dawar, who is missing for last more than eight years i.e. from 03.02.2016 whereby the missing report was recorded vide DD No. 29A and that the Appellants, who are the wife and daughter of Mr. Rajesh Kumar Dawar, had not been impleaded in the Partition Suit. 2.

It is submitted in the Appeal itself that the Civil Suit bearing No. 57/2025 for Declaration for civil death of Mr. Rajesh Kumar Dawar, is pending before the learned Civil Judge. this effect, have been disposed of by the Executing Court vide Order dated 06.06.2025.

Learned Senior Counsel on behalf of the Appellants, seeks permission to withdraw the present Appeal with liberty to pursue the remedies, in accordance with law.
