This writ petition has been filed in the name of the thirteen-yearold son of Late Shri Anurag Kumar Singh, who was an employee of the Container Corporation of India Ltd. ["Corporation"]. The petition has been filed by his paternal grandmother, Smt. Kusum Devi, claiming to be the legal guardian of the petitioner. Other than the respondent-employer and its officers, the mother and the eight-year-old sister of the petitioner have been arrayed as respondent Nos. 5 and 6 in the writ petition, respectively.

The relief sought in the writ petition is for a direction against compassionate appointment of the petitioner's mother [respondent No. 5] in the Corporation.

at the outset, that Smt. Kusum Devi does not seek any relief for herself in this writ petition. However, it is also accepted that she has not been appointed as the legal guardian of the petitioner. It is evident that the petitioner still has one parent, being his mother. 4.
In these circumstances, Mr. Tribhuvan seeks permission to withdraw this petition, with liberty to take alternative remedies, if any, to which the petitioner may be entitled.

The petition, alongwith the pending application, is dismissed as withdrawn, with liberty as aforesaid.
