% 16.12.2019 Petitioner is seeking interim bail for four weeks for medical treatment of his wife, as she is suffering from heart ailment and she is to be operated upon on 20.12.2019. Petitioner is facing trial in FIR No. 107/2019, under Sections 302/363/34 IPC & Sections 4 & 6 of Prevention of Children from Sexual Offences Act, 2015, registered at police station Nihal Vihar, Delhi.

Status report has been handed over in Court and the same is placed on record. As per the report received from Akash Healthcare Private Limited, the wife of the petitioner was examined and medical tests for thyroid, a complete blood count, USG were done but thereafter she did not go to the hospital to show the reports. Her last visit to the hospital was on 25.10.2019.

Learned Additional Public Prosecutor submits that interim bail application of the petitioner has been dismissed by the learned trial court vide order dated 03.12.2019.

According to learned counsel for the petitioner the wife of the petitioner is under treatment at Akash Healthcare Private Limited and the operation is to be scheduled for 20.12.2019. However, as per status report, no date for operation has yet been fixed.
