The present petition has been filed seeking quashing of FIR No. 527/2023 filed under Sections 176/506 of the Indian Penal Code, 1860 (IPC), registered at Police Station Mayur Vihar, Phase I, and the consequential proceedings arising therefrom.

Learned APP, appearing on behalf of the State, points out that in the present case, charge under Section 376(2)(n) of the IPC has already been framed against the petitioner by the Sessions Court vide order dated 08th April, 2024. Hence, it is submitted that the present petition is not maintainable.

Accordingly, counsel for the petitioner seeks to withdraw the present petition with liberty to file appropriate proceedings in accordance with the law.
