The accused/applicant seeks regular bail in case FIR No. 79/2016 of PS Badarpur for offence under Section 302/120B IPC. 2.
This bail application came up for the first hearing on 23.07.2025 before the predecessor bench and thereafter continued getting adjourned before different benches. Thereafter, along with 179 such old pending bail applications, this application was transferred to this bench and today is the first hearing before me.

At the outset today, learned counsel for accused/applicant seeks permission to withdraw this bail application with liberty to file afresh. accused/applicant was dismissed by this court on 11.10.2023. The accused/applicant is alleged to have committed armed dacoity at Toll Plaza and shot dead two persons. On the very first date (23.07.2025) the predecessor bench granted opportunity to the accused/applicant to place on record a copy of order dated 11.10.2023. But thereafter, despite three adjournments the same has not been filed till date. And now the bail application is sought to be withdrawn with liberty to file afresh. 4.
I find no ground to grant any liberty as prayed for. 5.
However, as requested, the bail and accompanying application are dismissed as withdrawn.
