Learned counsel for the appellant wishes to withdraw the present appeal with liberty to file another amendment application seeking incorporation of the relief of possession. He clarifies that certain averments in support of the said relief shall also need to be incorporated in the plaint. 2.

Accordingly, the present appeal is disposed of with liberty to the appellant to file an amendment application, which shall be considered by the learned Single Judge on its own merits. The rights and contentions of all the parties are left open.
