O R D E R

The present application is filed seeking interim bail on medical ground in FIR No. 92/2020 dated 07.08.2020, registered at Police Station Economic Offences Wing, for offences under Sections 409/420/120B of the Indian Penal Code, 1860. 2.
The medical report submitted by the concerned Jail Superintendent indicates that the applicant is required to undergo surgery of prostate.

It is submitted on behalf of the State that the jail authorities can get the surgery conducted from Safdarjung Hospital, however, this Court is of the opinion that every person has a right to take treatment of his choice on his own expenses in any hospital.

Undisputedly, the applicant has been in custody for a period of almost two years and ten months.

It is stated that the investigation is also complete and chargesheet has been filed. In such circumstances, in the opinion of this Court, the chances of the applicant evading the trial are unlikely.

In view of the above, the applicant is directed to be released on interim bail for a period of three weeks, if not in custody in any other case, on furnishing a personal bond for a sum of ₹20,000/- with two sureties of the like amount, subject to the satisfaction of the learned Trial Court/ Link MM/ Duty MM, on the following conditions:

The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case or tamper with the evidence of the case, in any manner whatsoever; c. The applicant shall, upon his release, provide the address where he would be residing after the release and shall not change the address without informing the concerned IO/ SHO;
d. The applicant shall, upon his release, give his mobile number to the concerned IO/SHO and shall keep his mobile phone switched on at all times;

The applicant is directed to surrender before the concerned Jail Superintendent upon expiry of the period of interim bail. 9.
Within a period of one week, the applicant shall indicate the hospital from where the surgery is to be conducted to the concerned Investigating Officer, and if it is felt that the surgery has been delayed only to prolong the applicant's release on interim bail, the State is at liberty to file an appropriate application for modification of the present order. 10.
The present bail application is allowed in the aforesaid terms.
