Learned counsel for respondent no.4/BSES submits that respondent no.4 is not a party to any settlement.

Learned counsel for petitioner submits that respondent no.4/BSES is not a contesting party.

In the above backdrop, learned counsel for petitioner on instructions of his client present in courtroom seeks permission to unconditionally withdraw this petition.

Accordingly, the petition and the accompanying application are dismissed as withdrawn, making it clear that this Court has not approved of the settlement and it is a case of unilateral withdrawal.
