Ms. Latika Chaudhary states that the accused has been granted bail but he has not been able to avail of the same on the account of the fact that the surety being offered by the accused is of his parents and married sister, who are all residents of Allahabad. The said surety is not being accepted on the ground that a local surety should be furnished. She states that, even though, the order granting bail does not impose any such condition, the learned ASJ is not accepting the said outstation surety. 2.

Mr. Rahul Mehra, learned Senior Standing Counsel for GNCTD submits that unless the court specifically so directs, the surety can be furnished by any person from any part of the country.

In these circumstances, learned ASJ may examine this aspect and, unless there are special reasons for not accepting the surety offered by the accused, the surety as offered by the accused may be accepted. Since the missing person has been located and she is with her mother, this petition does not survive.

This petition is accordingly disposed of.
