O R D E R

% 15.07.2016 The learned counsel for the parties submits that mediation settlement has been arrived at pursuant to the negotiations of the parties. A copy of the settlement arrived at on 04.07.2016 before the Dwarka Courts Mediation Centre has been produced; the same is taken on record. The settlement states inter alia that the appellant/wife agrees to settle all her disputes with the respondent/husband and that the latter has to pay Rs. 37,25,000/- as full and final settlement. The said amount is to be paid in four instalments- the first of Rs. 10 lacs was paid through the post dated cheque dated 20.07.2016. This was accepted by the appellant on 04.07.2016. The second instalment is to be paid on 20.09.2016 before the family court at Dwarka. The third

instalment is to be paid on 21.11.2016 before this court and the last instalment of Rs. 5 lacs to be paid at the time of recording of statement of the appellant during the proceedings for quashing of FIR No. 53/2010.

This Court is of the opinion that since the parties have entered into a lawful compromise, the third instalment (Rs. 10 lacs) should also be tendered before the learned Principal Judge of Family Court, on the date scheduled i.e. 21.11.2016. This suggestion is accepted by the counsel for the appellant who is under instructions as well as the respondent who is present in court. Accordingly, the agreement is hereby taken on the record and appeal is disposed of in these termssubject to the modification that the third instalment of Rs. 10 lacs would also be tendered before the Principal Judge, Family Court, Dwarka on 21.11.2016.
