Present petition has been filed primarily seeking return of the file by the Presiding Officer of the DRT-II to the Recovery Officer to enable the Recovery Officer to pass consequential orders. 2.

To say the least, the prayer made is strange. In the opinion of this Court, the prayer made is untenable in law. Such a relief should be sought by filing an appropriate application before the DRT and if the petitioner is aggrieved by the order passed thereon, then by approaching the DRAT. At this stage, learned counsel for the petitioner states that the prayer as framed flows from the order dated 28th July, 2023 passed by the DRAT in petitioner's favour.

This Court has perused the order dated 28th July, 2023 and, is of the view that the same does not flow from the aforesaid order. In any event, if the petitioner wishes to seek execution of the order dated 28th July, 2023, his remedy is not to file a writ petition.

Consequently, the present writ petition being misconceived is dismissed.
