1. This is an application filed by the respondents seeking modification of the order dated 06.08.2024.

2. Learned counsel for the respondents submits that the marks obtained by the petitioner in the written examination for recruitment as Constable(Tradesman) in the BSF for the vacancy year 2021-22 had been duly communicated to him vide letter dated 12.02.2024. A copy of the said letter alongwith a copy of the relevant extract of the Dak Register has been annexed with the application.

3. Issue notice. Learned counsel for the petitioner accepts notice. He, however, submits that the aforesaid letter on which the respondents are relying was never served on the petitioner. Having perused the documents filed with the application, we are of the view that even if, the petitioner's plea that he has till date not been served with a copy of the letter dated 12.02.2024 were, to be accepted the explanation given by the respondents cannot be disregarded. We are, therefore, of the view that the directions imposing costs of Rs.20,000/- on the respondents vide order dated 06.08.2024 is required to be recalled. We, accordingly, modify the order dated 06.08.2024 by waiving the costs of Rs.20,000/- imposed on the respondents.

5. The application stands disposed of in the aforesaid terms.
