Petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 has been filed on behalf of the Petitioner for quashing of CT Case No.2358/2019 titled as Small Farmers Agribusiness Consortium vs. M/s Ravi Kumar Agarwal & Anr. Under Section 138 NI Act. 2.

It is submitted that the Complaint was filed in the year 2019 and the Petitioner was summoned in the January, 2020. Petitioner came to know about pendency of the present Petition in the year 2021, when he was served with the Bailable Warrants.

The matter is stated to be pending at the stage of final arguments. 4.

Considering the totality of the circumstances and also that the cognizance has been taken way back in January, 2020 and the Petitioner has participated in the trial.
