O R D E R

% 08.10.2024 1.

This Court, by order dated 07.08.2024, had granted interim protection to the applicant from any coercive action subject to him joining and cooperating with the investigation.

Undisputedly, the applicant has since joined the investigation. 2.

The learned counsel for the applicant points out that the accused person, namely, Akshay Pahwa, who was named by the complainant as the accused in whose favour the money was transferred by the complainant, and who is also admittedly stated to be running the café - Black Mirror Cafe, has been admitted on regular bail.

It was noted in the order dated 07.08.2024 that the applicant is not the beneficiary of any of the cheated amount and the complainant had also not named him as the one who had wrongfully confined him in the café.

In view of the above, in the opinion of this Court, custodial interrogation of the applicant is not required at this stage. 5.

arrest, is directed to be admitted on bail on furnishing a bail bond for a sum of ₹25,000/- with one surety of the like amount subject to the satisfaction of the concerned SHO, on the following conditions:

a. The applicant shall join and cooperate with the investigation as and when directed by the IO; b. The applicant shall not leave the boundaries of the country without taking prior permission of the learned Trial Court;

c. The applicant shall not contact the complainant/ witnesses or tamper with the evidence in any manner;

d. The applicant shall give his mobile number to the concerned IO/SHO and shall keep his mobile phone switched on at all times;

e. The applicant shall provide the address of his residence to the concerned IO/SHO and shall not change the same without informing the IO/SHO. 6.

In the event of there being any violation of the stipulated conditions, it would be open to the State to seek redressal by filing an application seeking cancellation of the bail. 7.

It is clarified that the observations made in the present order are for the purpose of deciding the present pre-arrest bail application, and should not influence the outcome of the trial and should not be taken, as an expression of opinion, on the merits of the case.
