This petition is filed by the Petitioners under Sections 14 and 15 of the Arbitration and Conciliation Act, 1996 ('1996 Act') for appointment of a substitute Arbitrator on the ground that the Sole Arbitrator appointed by this Court on 16.04.2015 has recused from the proceedings. The order of recusal dated 15.04.2025 is on record.

Issue notice.

Mr. Pratham Vir, learned counsel accepts notice on behalf of the Respondent.

Considering that the learned Arbitrator has recused from the proceedings, with the consent of the parties, this petition is allowed appointing Ms. Justice Sangita Dhingra Sehgal, former Judge of this Court (Mobile No. 9717592061) as substitute Arbitrator to adjudicate the disputes between the parties. Arbitral proceedings will resume from the stage at O.M.P. (T) (COMM.) 63/2025 The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. which they were left by the erstwhile Arbitrator. Arbitral proceedings will be held under the aegis of Delhi International Arbitration Centre ('DIAC'). Fee of the Arbitrator shall be fixed as per fee schedule under DIAC (Administrative Cost & Arbitrators' Fees) Rules 2018. 5.

Learned Arbitrator shall give disclosure under Section 12 of the 1996 Act before entering upon reference.

It is made clear that this Court has not expressed any opinion on the merits of the case and all rights and contentions of the respective parties are left open.
