Petitioner is plaintiff before the learned Trial Court and has filed a suit i.e. CS(DJ) No. 128/2022 seeking recovery of Rs. 1,48.05,511/-. 2.

The petitioner is aggrieved by order dated 18.07.2024 whereby the learned Trial Court has merely issued notice with respect to its one application moved under Order XXXIX Rule 1 and 2 of CPC instead of taking up same and deciding the same forthwith. 3.

Learned counsel for respondent No. 2 appears on advance notice. 4.

At the very outset, learned counsel for respondent No. 2 also informs that the parties are trying to amicably settle the matter. It is also informed that connected matters between the same parties i.e. FAO(OS) 142/2023 and CM(M) 3121/2024 1 The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. FAO(OS) 143/2023, are fixed for today itself at 2:00 p.m. before the learned Mediator, Delhi Mediation and Conciliation Centre, New Delhi. 5.

After hearing the arguments for some time, learned counsel for petitioner states that he does not wish to press his present petition anymore. 6.

The present petition stands disposed of as not pressed. 7.

Since, the learned Mediator is already seized with the matters between the same parties as in the present petition, learned Mediator is also requested to consider possibility of resolution of disputes raised in the aforesaid suit also while considering the above mediation.

Both the parties would render due assistance in this regard to the learned Mediator.
