Petitioner is defendant before the learned Trial Court and is aggrieved by order dated 02.07.2024 whereby PW2 was permitted to be examined and cross-examined and the SPA was permitted to be taken on record.

After hearing the arguments for some time, learned counsel for the petitioner states that without prejudice to his rights and contentions, he may be permitted to withdraw the present petition. He also seeks liberty to agitate the issue involved in the present petition before the learned Trial Court at the time of final arguments.

Petition is, accordingly, dismissed as not pressed. All the rights and contentions of the parties are reserved.
