The present writ petition has been filed seeking directions to transfer the ownership of the vehicle bearing Registration No. DL-1-LAE-0632 Bolero Mahindra in the name of the petitioner. 2.

Today, learned counsel appearing for the petitioner submits that instead of the petitioner, the petitioner is now praying that the ownership of the vehicle in question be transferred in the name of the wife of the petitioner. For this purpose, he relies upon the judgment dated 24th April, 2024, passed by learned Civil Judge, District South East, Saket Courts, New Delhi, in Suit No. CS SCJ/701/2023, wherein, it has been held as follows: "xxx xxx xxx 11.

Objection given on behalf of the defendant no. 1, the present suit is decreed in favour of the plaintiff no. 2 in the following manner: (i) plaintiff no. 2 is directed as the owner qua the vehicle bearing No. DL-1-LAE-0632 (Sic) Bolero Pickup make by Mahindra Co. and (ii) the defendant no. 2 is restrained from interfering in the peaceful and absolute possession of the plaintiff no. 2 of the above said vehicle in any manner.

This Court notes that the learned Trial Court has already declared the wife of the petitioner herein as the owner of the vehicle in question. 4.

Learned counsel appearing for the petitioner further submits that the requisite tax has also been deposited by the petitioner with the agency of the Regional Transport Office ("RTO").

In response, learned counsel appearing for the respondent no.1 submits that action had not been taken earlier by the respondents, as the requisite tax had not been paid by the petitioner and the petitioner had never approached the respondents for the purposes of transfer of the ownership of the vehicle, in the name of the wife of the petitioner. 6.

Learned counsel for the respondent no.1 submits that since now there is a decree in favour of the wife of the petitioner, the respondent no.1 would duly transfer the ownership of the vehicle in favour of the wife of the petitioner.

Having heard learned counsel for the parties, this Court notes that since there is a decree in favour of the wife of the petitioner, wherein, the wife of the petitioner has been declared as the owner of the vehicle in question, there is no impediment in transferring the ownership of the vehicle in favour of the wife of the petitioner.

respondent no.1, along with the requisite documents. Upon the petitioner complying with all the formalities, the respondent no.1 shall duly transfer the ownership of the vehicle bearing Registration No. DL-1-LAE-0632, Bolero Mahindra, in favour of the wife of the petitioner. The petitioner is directed to file the requisite application along with challans of taxes paid with the respondents, within a period of ten days from today. 9.

Upon the petitioner filing the application and complying with all the formalities, the respondent no.1 shall transfer the ownership of the vehicle in question in favour of wife of the petitioner expeditiously, preferably, within four weeks from the date of the filing of the application. 10.
