CORAM:

HON'BLE MR. JUSTICE JASMEET SINGH

O R D E R

% 26.11.2024 1.

This is a petition filed under Section 482 Cr. PC seeking quashing of F.I.R. 422/2015 under Section 308/323/452/506/34 of IPC at Police Station Neb Sarai and consequent trial and proceedings in Sessions Case No. 7439/2016 pending before Ld. ASJ (South), Saket Courts, New Delhi. 2.

As per the FIR, an altercation took place between the parties wherein the petitioners and respondents were injured. On the statement of respondent No.3, FIR was lodged.

3.

The nature of the injury is simple.

4.

During the pendency of the proceedings, the parties have arrived at a settlement on 10.01.2022 wherein the parties have agreed to settle their disputes and cooperate in quashing of the F.I.R. 5.

The petitioners and respondents are present in Court and are identified by IO SI Vineet, Police Station Neb Sarai.

6.

The amount as stated in the settlement has been paid. 7.

Parties state that they have arrived at the settlement out of their own free will without any threat, pressure, coercion or undue influence. 8.

I am of the opinion that no useful purpose would be served in prosecuting the FIR any further on the ground that the parties have arrived at a voluntary settlement and settled their disputes. 9.

I am convinced that quashing of such proceedings on account of compromise would bring about peace and would secure ends of justice. The Court does not see any fruitful purpose if criminal proceedings as permitted to continue any further. It is a fit case for quashing. In this view of the matter, there is no reason to continue the proceedings. 10.

Hence, F.I.R. 422/2015 under Section 308/323/452/506/34 of IPC at Police Station Neb Sarai along with consequent proceedings arising therefrom are hereby quashed.
