The present writ petition is filed by the petitioner seeking protection from Respondent No.5, who is the brother of the petitioner.

The petitioner claims that Respondent No.5 has been threatening him since they are involved in a property dispute after the death of their father.

At the outset, the learned Additional Standing Counsel for the State points out that the petitioner and Respondent No.5 have been litigating over a property, and they have also registered criminal cases against each other which are pending investigation.

He submits that recently, another complaint was given by the petitioner making certain allegations against Respondent No.5. He submits that the same is being looked into and appropriate action will be taken in accordance with law. He further submits that insofar as any threat to life and liberty is concerned, the number of the Beat Officer would be provided to the petitioner who would be at liberty to contact the said Officer in case he feels any immediate threat to his life and liberty.

Undisputedly, the parties are brothers and have been embroiled in a dispute over a property after the death of their father, due to which, multiple FIRs are registered by them against each other. The possibility of the concerned parties giving exaggerated complaints due to their private dispute cannot be ruled out, and therefore, this Court does not consider it apposite to pass an order directing the State to provide any security to the petitioner at this stage.

It is relevant to note that even otherwise, the police is duty bound to provide security to the life and liberty of every citizen and as and when any complaint is received in regard to commission of a cognizable offence, appropriate action is required to be taken without any delay.

Even so, let the phone number of the Beat Officer be provided to the petitioner, who would be at liberty to contact the said Officer in case he feels any immediate threat to his life and liberty.

Needless to say, as and when any complaint is filed, the police shall take action in accordance with law. 10.
No further orders are required to be passed at this stage. 11.
The petition stands disposed of with the aforesaid observations.
