After some arguments, Mr Sanjeev Sagar, learned standing counsel for MCD/appellant, says that given the apparent errors in the trial court judgment, which were predicated on the assertions made in the plaint, the appellant would approach the trial court.

The appeal is, accordingly dismissed as withdrawn, with liberty to the appellant to approach the trial court, albeit, as per law. 3.
