Petitioner impugns order dated 03.12.2019 whereby the Estate Officer has passed an order directing the petitioners to evict the public premises No. J-617, Kali Bari Marg, New Delhi and also to pay damages for use and occupation.

Learned counsel for the respondent submits that the petitioner has to pay damages as per the Government rate which is 40 times the normal license fee with telescopic increment every month. 3.

Learned counsel for the petitioner undertakes that the petitioner shall vacate and hand over peaceful, vacant possession of the said residential quarter on or before 31.03.2020 and shall also pay damages for use and occupation as per the rate prescribed by the Government. 4.

The undertaking is accepted.

Subject to petitioner filing an affidavit of undertaking within one week that petitioner shall vacate and hand over peaceful, vacant possession of the public premises No. J-617, Kali Bari Marg, New Delhi on or before 31.03.2020 and shall pay the damages as per the rules prescribed by the Government and further complying with the undertaking, no coercive action shall be taken till 31.03.2020. 6.

The petition is accordingly disposed of.
