Petitioner is the defendant before the learned Trial Court and is aggrieved by order dated 26th October, 2023 whereby his application under Order VII Rule 11 CPC has been dismissed.

However, Mr. Jai Ram Garg, learned counsel for the petitioner states that the matter has already been amicably settled and pursuant to such settlement, the plaintiff has already withdrawn the suit and, therefore, nothing survives in the present petition.

In view of the above statement and since the suit has already been disposed of as settled, the present petition is also disposed of as having become infructuous.
