After hearing arguments for some time, learned counsel for petitioner, without prejudice to his rights and contentions, does not press the present petition. He, however, submits that the learned Controller would be hearing arguments on leave to defend application very shortly and it be clarified that said application be decided, without being influenced by the observations appearing in impugned order dated 07.05.2025. 2.

Learned counsel for respondent appears on advance notice and has no objection to the abovesaid limited aspect.

Resultantly, the present petition is disposed of as not pressed. All rights and contentions of the parties are reserved.

It is also made clear that the impugned order would not influence the mind of the learned Controller while deciding the application moved by the tenant, wherein he is seeking leave to defend.
