The petitioner has approached this Court assailing the order dated 01.05.2024 vide which he has been transferred from 16th Battalion, CRPF at Mathura, Uttar Pradesh to 169th Battalion, CRPF at Jhargram, West Bengal. 4.

granted time till 30.09.2024 to join his new place of posting, in terms of the impugned order.

Learned counsel for the respondents, on instructions from the DIG (Law), CRPF, submits that even though the respondents may not be in a position to retain the petitioner till 30.09.2024 at 16 Battalion, CRPF at Mathura, Uttar Pradesh, they will ensure that after he is relieved from 16th Battalion, CRPF, he will be attached in a suitable position in Delhi for the intervening period so that he can join 169th Battalion, CRPF at Jhargram, West Bengal on or before 30.09.2024.

In the light of this fair stand taken by the respondents, we dispose of the writ petition by granting the petitioner time till 30.09.2024 to report at 169th Battalion, CRPF at Jhargram, West Bengal. The petitioner will, within 10 days, file an affidavit undertaking to join 169th Battalion, CRPF at Jhargram, West Bengal on or before 30.09.2024. 7.
It is further made clear that as assured by the respondents, even if the petitioner is relieved from 16th Battalion, CRPF before 30.09.2024, he will be attached in a suitable position in Delhi so as to enable him to report at 169th Battalion, CRPF at Jhargram, West Bengal on or before 30.09.2024.
