The Petitioner, an NGO, has invoked the jurisdiction of this Court seeking directions to Respondent No. 1, Delhi Metro Rail Corporation (DMRC) to take immediate action for removing/ taking possession of unauthorized occupants "Anytime Tour & Travels" from using the premises of the toilet blocks near Gate No. 8 of Kashmere Gate Metro Station, Delhi, and other locations. Further, they also seek directions for DMRC to take actions for cancellation of the Agreement dated 7th October, 2019 entered into with Respondent No. 3.

At the outset, Mr. Puskhar Sood, counsel for Respondent No. 1, states The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

He places reliance on letter dated 15th July, 2024, copy whereof has been handed over across the board and is taken on record. The operative portion of the said communication reads as follows: "To, Dated: 15.07.2024 M/s Snapex Overseas (Garv Toilet) Vidya Mansion, Sector-208, Faridabad. Haryana-121 001 Sub: Termination Notice (Contract Agreement between DMRC and M/s Snapex Overseas (Garv Tollet).

(ii) Show Cause Notice No. Nil dated- 06.06.2024 xx..........xx...........xx In view of above, a show cause notice of termination has already been served to you vide referred notice dated- 06.06.2024. The curative period of 30 days to amend the detect has already been lapsed. Hence, the contract agreement dated 17.10.2019 signed between DMRC and M/s Snapex Overseas (Garv Toiet) stand terminated with immediate effect. Further, you are directed to vacate the premises with all man and material within 10 days from issuance of the Termination Notice. In light of the above, in the opinion of the Court, the grievance of the Petitioner stands redressed and no further directions are required to be issued. Accordingly, the present petition has disposed of along with pending applications.
