This is a petition under Section 528 of BNSS seeking quashing of FIR No. 126/2013 under Section 465/467/471 IPC registered at P.S.Hazrat Nizamuddin, South East District as also the consequent proceedings emanating therefrom.

Learned APP states that chargesheet has already been filed in the case and the matter is listed for charge before the trial court, and therefore, the petitioner may reserve his arguments to be addressed at the stage of charge before the trial court.

After part submissions, learned counsel for the petitioner seeks permission to withdraw the present petition with liberty to place all the submissions before the trial court at the stage of charge. The statement made by learned counsel is taken on record and the petition is dismissed as withdrawn with liberty as prayed for. All rights and contentions of the parties are kept reserved. Petitioner is at liberty to appear through video-conferencing before the trial court at the stage of arguments on charge.
