Learned counsel for the petitioner, very fairly, admits that the present suit has been rejected by the learned Trial Court on 12th September, 2024. He also states that plaintiff is in the process of challenging the above said rejection by taking appropriate recourse to law. 2.

By virtue of the present petition, the plaintiff had merely challenged the dismissal of her application filed under Order XII Rule 6 CPC. 3.

Be that as it may, since the above suit has already been rejected, the present petition does not survive anymore and, therefore, the present petition is disposed of as having become infructuous.

However, needless to say, in case the above said order of rejection is set aside, the petitioner herein would be at liberty to seek revival of the present petition.
