The present Petition has been filed on behalf of the Petitioner under Section 115 of the Code of Civil Procedure, 1908 [hereinafter referred to as "CPC"] against the order dated 07.04.2025 passed by learned Civil Judge (Senior Division), Rohini Courts, Delhi [hereinafter referred to as "Impugned Order"]. By the Impugned Order, the Application under Order VII Rule 11 of the CPC filed by the Petitioner has been dismissed by the learned Trial Court.

After some arguments, learned Counsel for the Petitioner submits that he limits his challenge in the present Appeal to a direction from this Court that the findings of the Impugned Order will not come in his way at the time of the final adjudication of the matter.

Accordingly, it is clarified that the findings of the learned Trial Court are on a demurer as is the case in applications under Order VII Rule 11 of the CPC and these shall not come in the way of the defence of the Petitioner before the learned Trial Court.

It is clarified that the rights and contentions of both the parties are left to be agitated before the learned Trial Court. 7.

The Petition is disposed of in the aforegoing terms. 8.
