An application under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 ('BNSS') has been preferred on behalf of the petitioner for extension of interim bail for a period of 60 days in FIR No.823/2015 under Sections 302/34 IPC registered at P.S. Hari Nagar. 2.

Learned counsel for the petitioner submits that petitioner had been granted interim bail vide order dated 01.05.2024 for a period of one month by the learned Trial Court. Further an application for extension of interim bail was dismissed vide order dated 05.07.2024, but the petitioner failed to surrender, since he had undergone surgery. Thereafter, another application for extension of interim bail was dismissed by the learned Trial Court vide order dated 01.08.2024.

Learned APP for the State has filed Status Report on record and submits that on verification, petitioner was found to be suffering from 'TB Meningitis with Hydrocephalus' and was operated (VP Shunt) on 01.08.2024. regular follow-up in OPD.

Perusal of the FIR reveals that petitioner is involved in murdering a jail inmate with co-accused, within the jail premises itself with sharp edged weapons. Petitioner has already been discharged from the hospital and has only been advised follow-up in OPD. The treatment of petitioner seems to be feasible in the Jail hospital.

Considering the totality of facts and circumstances, no grounds for extension of interim bail are made out. Application is accordingly dismissed. Pending applications, if any, also stand disposed of. Petitioner shall accordingly surrender before Superintendent Jail on 14.08.2024.

A copy of this order be forwarded to concerned Superintendent Jail for information.
