After some arguments, learned Counsel for the Petitioner restricts his prayers in the present Petition to the fact that the prima facie finding as is set out in the Impugned Order should not come in his way during final arguments before the learned Trial Court.

Learned Counsel for the Respondent submits that he has no objection to this prayer.

It is directed that the finding in the Impugned Order is prima facie. Both the parties are permitted to agitate all their contentions before the learned Trial Court.

The Petition is disposed of in the aforegoing terms. Pending Application also stands closed.
