The petitioner is seeking initiation of contempt proceedings against the respondent for wilful disobedience of the directions contained in the order dated 27.03.2024 passed by the learned MM, Mahila Court-02, North District.

None is present for the respondent despite sending advance notice.

Learned counsel for the petitioner submits that despite there being a clear direction by the learned MM with regard to the payment of maintenance to the petitioner and her two children, the respondent is avoiding making payment of ad interim maintenance since 18.11.2023.

It is however also stated that in the meanwhile, the petitioner has approached the learned MM on 07.08.2024 and bailable warrants have been issued against the respondent through the SHO concerned and the matter is now listed on 13.11.2024.

After some arguments, learned counsel for the petitioner requests permission to withdraw the present petition with liberty to approach this Court afresh in case the orders of the learned MM are not complied with.

It is ordered accordingly.
