Learned counsel for the petitioner submits that pending the present proceedings, a fresh Show Cause Notice dated 21.11.2023 has been issued to the petitioner, which has been duly responded to by the petitioner and is under adjudication.

Learned counsel for respondent submits that in view of the adjudication proceedings pending, the amount would be appropriate as proposed in the Show Cause Notice only after the conclusion of the adjudication proceedings. He submits that the petition has become infructuous.
