Learned counsel representing the respondent/Corporation, on instructions, has submitted that for certain reasons the subject tender has been cancelled and a decision has been taken to float a fresh tender. tender and to invite tenders afresh to the petitioner within a week. 5.

In view of the aforesaid, the writ petition is rendered infructuous and is hereby dismissed as such.

Needless to observe, in case the petitioner in any manner is aggrieved by the cancellation of the tender and the decision to invite fresh tender, it will be open to the petitioner to challenge the same by way of taking appropriate proceedings before appropriate Court/Forum.
