The petitioner challenges the order dated 02.12.2022 passed by learned Metropolitan Magistrate, Dwarka Courts, Delhi in CC No. 2527/2019, pursuant to which the application under Section 311 of the Code of Criminal Procedure, 1973 filed by the petitioner was dismissed.

The learned counsel for the petitioner submits that the proceedings had since continued which led to conviction of the petitioner.

He seeks liberty to withdraw the present petition with liberty to take appropriate remedies before the learned Appellate Court.

The petition stands dismissed as withdrawn. Pending application also stands disposed of.
