21299/2025 SEEKING EXTEND/CONTINUE THE FURLOUGH 1.

This is a Writ Petition, seeking extension/continuation of the furlough already granted for a further period of three months on the ground that petitioner has to repair her house and such repair could not be completed within a period of 21 days furlough granted to her. 2.

It is submitted that petitioner was granted furlough by the competent authority vide its order dated 09.07.2025 for a period of 21 days and in terms of the said order, petitioner is required to surrender today i.e. 24.07.2025.

Learned ASC, relying on the Standing Order No. 01/2019 issued by the Office of Director General of Prisons (HQ), submits that the grant of subsequent spell of furlough should be made only after a gap of one month from the date of surrender after availing the previous furlough, even though, such gap between the two furloughs may be relaxed by the competent authority on the basis of verified emergent reasons/cause to the satisfaction of the Superintendent.

After part submissions, learned counsel for the petitioner makes a prayer that the present petition may be forwarded to Superintendent Jail to be treated as a representation for extension/grant of fresh furlough. 5.

Request so made is not opposed.

Petition is disposed of with direction that W.P.(C) No. 2284/2025 be treated as a representation to the competent authority i.e. Jail Superintendent, to be decided within two weeks as per Standing Orders/Prison Rules.

However, it is clarified that this order may not be misinterpreted as an order extending furlough granted to the petitioner till the disposal of his representation.
