The present writ petition under Article 226 and 227 of the Constitution of India seeks to assail the order dated 03.07.2023 passed by the learned Central Administrative Tribunal in M.A. No. 768/2023 in O.A. NO. 394/2016. Vide the impugned order, the learned Tribunal has condoned delay of 40 days in filing of the original application by the respondent. The petitioner also assails the order dated 14.08.2023 vide which it's review application seeking review of order dated 03.07.2023 was rejected.

After some arguments, learned counsel for the petitioner seeks leave to withdraw the present writ petition.
