% 07.11.2024 CRL.M.A. 33423/2024 (for specific direction for disposal of all pending applications) 1.
The writ petition filed by the petitioner was disposed of directing the learned Trial Court to make endeavours to decide the case within a period of four months from date. 2.
The present application is now filed praying as under: "The applicant most humbly prays this Hon'ble Court to direct the disposal of all long-term pending Applications more specifically the Application bearing No 3023 of 2018 and Salary Attachment Application of Respondent No 1 in Execution Petition No 69 of 2013 in four months (which is requisite for leading Evidence) before moving ahead for Evidence thereby waiving the Cost of Rs1000/- unfairly imposed on the Applicant for pressing the disposal of long-term pending Applications in Domestic Violence Case No 319 of 2017 along with the disposal of Domestic Violence Case No 319 of 2017 expeditiously." 3.
In regard to the prayer seeking directions for disposal of all the long terms applications, this Court is of the opinion that when the learned Trial Court has been directed to dispose of the entire case itself, no separate direction ought to be passed for disposal of applications.

Whether the pending application needs to be decided prior to disposal of the case will be seen by the learned Trial Court and no orders can be passed in that regard.

In regard to the directions for waiving the cost of ₹1,000/-, the petitioner is at liberty to file an appropriate petition. However, no application in the disposed of case can be entertained in that regard.

The application is disposed of with the aforesaid observations.
