Mr. Pradeep Kumar, Adv.
CORAM:
HON'BLE MR. JUSTICE DHARMESH SHARMA

% 07.10.2024 1.
No one appeared for the petitioner when the matter was called. 2.
Having heard the learned counsel for the respondents and on the perusal of the record, unhesitatingly, this court finds that the present contempt petition is not made out.
3.
In a nutshell, there was a dispute between the parties with respect to a plot of land falling in Khasra No. 410 in Village Neb Sarai, New Delhi, and it appears that the parties entered into an MOU dated 10.08.2015, whereby the respondent acknowledged their mistake that they were occupying a portion of the petitioner‟s land and they vacated the said portion in favour of the petitioner. 4.
Consequently, on a petition filed under Section 482 Cr.P.C., the FIR bearing No. 215/2015 under Sections 420/467/468/471/34 IPC registered with P.S. Neb Sarai, was quashed in W.P.(Criminal) 2011/2015 vide Order dated 14.12.2015.
5.
It appears that, thereafter the respondent No.1 filed a civil suit bearing No. 554/2017, claiming ownership with regard to a land The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. falling in Khasra No. 408/2. It is the filing of the aforesaid civil suit that precipitated the petitioner to seek initiation of the contempt proceedings against the respondents.
6.
Be that as it may, the civil suit was filed on 02.06.2017 and the present contempt petition has been filed on 13.12.2019. 7.
The contempt petition is without any cause of action, and further hit by law of limitation under Section 20 of the Contempt of Courts Act, 1971.
8.
Hence, the same is dismissed.
