This application under Section 439 Cr.P.C. has been filed by the Petitioner for grant of bail in case FIR No. 922/2022 under Sections 365 IPC, registered at PS: Shahbad Dairy.

At the outset, Ms. Shubhi Gupta, learned APP states that evidence of prosecution witness has commenced before the Trial Court. One material witness has been examined and three material witnesses, the widow of the deceased and two daughters are yet to be examined and now the case is fixed before the Trial Court on 29.07.2024.

At this stage, counsel for the Petitioner without adverting to the merits, seeks leave to withdraw the Bail Application with liberty to approach the Court after the remaining three material witnesses are examined.
