It is contended by Mr. Trivedi that the issue which arises for consideration in the present petition is covered by the judgment of the Supreme Court in the case of Director (Admin and HR) KPTCL and Ors v. CP Mundinamani and Ors, CA 2471/2023 decided on April 11, 2023. He states that the benefit thereof must be given to the petitioner herein. 2.

On the other hand, learned counsel for the respondents states that appropriate shall be, that the present petition is considered as a representation on behalf of the petitioner to be decided by the respondents, keeping in view of the judgment of the Supreme Court as referred above. 3.

Noting the submission of the learned counsel for the respondents, we direct the respondents to consider and decide the petition as a representation on behalf of the petitioner, keeping in view the judgment of the Supreme Court as referred above.

If the petitioner is entitled to the benefits thereof, the same shall be released to him within six weeks thereafter.

If the respondents are of the view that the benefits are not available, the reasons thereof shall be conveyed to the petitioner within the same period to enable the petitioner seek such remedy as available in law. 6.

Petition is disposed of.
