The present petition is filed under Section 397 read with Section 401 of the Code of Criminal Procedure, 1973 ('CrPC'), challenging the order dated 23.05.2023 (hereafter 'the impugned order'), passed by the learned Family Court, Central District, Tis Hazari Courts, in MT Case No. 117/2021 titled as Ruchi Anand v. Jai Prakash Singh.

The learned Family Judge, by the impugned order, has directed the petitioner to pay an ad interim maintenance of ₹5,000/- per month to the petitioner from the date of filing of the petition, that is, 02.03.2021, till the disposal of the application for interim maintenance.

maintenance is pending consideration before the learned Family Court. The ad interim order is not a revisable order under Section 397 of the CrPC.

Moreover, the grant of maintenance of ₹5,000/- per month to the respondent wife as an ad interim measure, in the opinion of this Court, is not unreasonable.

In view of the above, the petition is dismissed. 8.

The petitioner is at liberty to take all arguments before the learned Trial Court at the time of consideration of the application for interim maintenance.
