Learned APP appearing on behalf of the State submitted that the closure report has already been filed and the same is on record (annexed as Annexure P-5 to the instant petition). It is further submitted that the Court concerned has granted regular bail to the petitioner vide impugned order dated 28th August, 2023.

Learned counsel appearing on behalf of the petitioner submitted that the victim has turned hostile and therefore, there is no purpose in further proceeding with the instant petition.

Taking into consideration the closure report, impugned order along with the fact that the victim has turned hostile, this Court is of the view that no ground is made out for cancellation of the bail granted by the Court concerned vide order dated 28th August, 2023. 4.

In view of the above, the instant petition is dismissed, accordingly.
