% 08.12.2017 C.Ms. 44701-02/2017 in Review Petition No. 402/2017 By way of this application, correction of typographical error in the order of 13th October, 2017 is sought.
Since none had appeared when order in the review petition was passed on 13th October, 2017, therefore, requirement of issuance of notice to respondents is dispensed with.
Upon hearing, the application is allowed and it is directed that the first paragraph in the order of 13th October, 2017 in the review petition shall read as under:- "Review of judgment of 8th December, 2016 is sought by learned counsel for appellant on the ground that impleadment of appellant by the learned Motor Accident Claims Tribunal (MACT) was in nullity, as appellant was the broker who had not issued the cover note in question on behalf of insurer and only photocopy of insurance cover note has been produced MAC.APP/339/2011
and not the original, and so no liabliity can be put on appellant- Manoj Bhatia."
Registry is directed to carry out necessary corrections. With aforesaid directions, this application is disposed of. A copy of order of 13th October, 2017 with correction be given dasti to counsel for petitioner.
