This petition has been filed for grant of regular bail under Section 439 read with Section 482 Cr.P.C. in FIR No. 0594/2020 dated 08.09.2020 registered under Section 354 IPC and Section 8 of the POCSO Act at P.S.: Naraina.

After canvassing some arguments, learned counsel for the Petitioner, on instructions, seeks to withdraw the present application with liberty to approach the Court after one remaining material witness is examined by the prosecution.

Learned counsel for the Petitioner also draws the attention of this Court to the order passed by this Court on 01.08.2022 wherein while declining the bail at that stage, the Court had directed the learned Trial Court BAIL APPLN. 3866/2022 The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. to conclude the trial within a period of nine months from the date of receipt of the order and submits that the directions passed by this Court have not been complied with, in as much as till date only three prosecution witnesses have been examined.

There is no gainsaying that the order passed by this Court has to be complied with by the learned Trial Court, and therefore Trial Court is requested to make every endeavour to conclude the trial as expeditiously as possible.

The application is disposed of as withdrawn granting liberty to the Petitioner, as prayed, in accordance with law.
